Inheritance law, an integral part of civil law in Romania, regulates the transfer of a deceased person’s estate to his heirs. It is important for both potential heirs and legal professionals to understand under what conditions this right can be lost. The Romanian Civil Code provides a well-defined legal framework that not only details how inheritance rights are obtained, but also the circumstances under which they can be lost.
One of the reasons why a person may lose the right to inherit is unworthiness of succession.
Another way in which the right to inherit can be lost is by renouncing the inheritance. The Civil Code stipulates that a person who is entitled to inherit may renounce the inheritance within one year of the opening of the succession. This renunciation must be made by means of an authentic declaration and is unilateral, voluntary and irrevocable. By this renunciation, the successor definitively loses his right to inherit and his share will be redistributed to the other heirs. It is important to understand that the renunciation cannot be conditional or partial: the person concerned must renounce the entire estate.
Failure to exercise the right of succession option within the legal time limit of one year from the opening of the inheritance is another situation in which the right to inherit may be lost. If the heir does not exercise this right within the time limit, he is deemed to have renounced the inheritance.
Regarding testamentary succession, there is also the possibility of losing the right to inherit by revoking the legacies or forfeiting the right to receive them. The testator can revoke the legacy either explicitly, through a new will or notarial deed, or implicitly, through acts that suggest the intention to revoke the legacy, such as the alienation of the property subject to the legacy. The legatee may also lose the right to collect the legacy in various situations, such as death before the testator, inability to receive the legacy, or failure to fulfill the obligations imposed by the testator. This can be effectively managed with the assistance of a Romania law firm specializing in inheritance matters.
Thus, the loss of the right to inherit may occur in various circumstances provided for by law, either because of serious acts committed against the deceased, or as a result of the will of the successor or of failure to exercise rights within the legal time limit. In testamentary succession, revocation of legacies and forfeiture of the right to collect them may also result in the loss of succession rights. Knowing and understanding these legal provisions is fundamental to protecting inheritance rights, and in cases of uncertainty, it is advisable to consult a specialist in inheritance law.
